1. Purpose

Go Dokan respects intellectual property rights and expects Vendors, Buyers, advertisers and other Platform users to do the same.

This Policy establishes rules for:

  • Product names and descriptions
  • Trademarks and logos
  • Copyrighted photographs, videos and written content
  • Product packaging and artwork
  • Brand authorization
  • Software and digital Products
  • Vendor-created marketing materials
  • Sponsored advertisements
  • Intellectual property complaints
  • Counterfeit and unauthorized Products
  • Removal, suspension and enforcement procedures

The purpose of this Policy is to protect legitimate rights holders while allowing Vendors to lawfully sell genuine Products through the Go Dokan marketplace.


2. Scope

This Policy applies to intellectual property appearing on or connected with Go Dokan, including:

  • Product listings
  • Product names
  • Product descriptions
  • Product photographs
  • Product videos
  • Product manuals and catalogues
  • Brand names
  • Trademarks
  • Logos
  • Packaging images
  • Promotional banners
  • Sponsored listings
  • Advertisements
  • Vendor storefronts
  • Reviews and user-generated content
  • Software and digital Products
  • Downloadable materials
  • Product documentation
  • Campaign content
  • Go Dokan website and applications
  • Other content submitted to or displayed through the Platform

3. Types of Intellectual Property

Copyright may protect original creative works such as:

  • Photographs
  • Videos
  • Product descriptions
  • Articles
  • Graphics
  • Illustrations
  • Software code
  • Website content
  • Marketing materials
  • Catalogues
  • Manuals
  • Music and audio
  • Original designs

A Vendor must not copy another person's copyrighted material without permission or another valid legal basis.

3.2 Trademarks

Trademarks may include:

  • Brand names
  • Logos
  • Symbols
  • Product marks
  • Service marks
  • Trade names
  • Distinctive branding

Vendors may use a trademark when reasonably necessary to accurately identify a genuine Product, provided the use does not falsely suggest authorization, sponsorship, partnership or endorsement.

3.3 Trade Names and Business Identity

Users must not create a Vendor account, storefront, advertisement or Product listing that falsely represents an association with another business.

Examples include:

  • Using another company's name as your own Vendor name
  • Creating a fake authorized distributor account
  • Using another company's logo as your storefront identity
  • Pretending to be an official manufacturer
  • Claiming to be an authorized service centre without evidence

3.4 Product Designs and Packaging

Vendors must not knowingly sell or advertise Products that unlawfully copy protected:

  • Product designs
  • Packaging
  • Labels
  • Artwork
  • Product appearance
  • Brand presentation

Go Dokan may request source documentation where the authenticity or authorization of a Product is questioned.


4. Vendor Intellectual Property Responsibilities

Every Vendor is responsible for ensuring that its Product listings and promotional content are lawful.

The Vendor must ensure that it has the right to use:

  • Product photographs
  • Product videos
  • Product descriptions
  • Brand names
  • Logos
  • Product documentation
  • Manufacturer information
  • Marketing materials
  • Catalogue images
  • Technical specifications
  • Warranty materials

The Vendor must not upload content merely because it is publicly available on the internet.

Public availability does not automatically mean that content is free to copy.


5. Product Images

Vendors should use:

  • Original photographs
  • Manufacturer-authorized photographs
  • Distributor-authorized catalogue images
  • Images for which the Vendor has a valid licence or permission

The Vendor must not copy images from:

  • Competitor websites
  • Other marketplaces
  • Social media accounts
  • Photographer portfolios
  • Manufacturer websites without authorization
  • Online catalogues without permission

unless the Vendor has a lawful right to use the material.


6. Product Descriptions

Product descriptions must be:

  • Accurate
  • Relevant
  • Original or lawfully licensed
  • Non-misleading
  • Appropriate for the listed Product

Vendors should not copy another Vendor's complete Product description without permission.

Technical specifications supplied by a manufacturer may be used where the Vendor is authorized to reproduce them or where their use is otherwise lawful.


7. Brand Authorization

Go Dokan may request evidence showing that a Vendor is authorized to sell or distribute branded Products.

Evidence may include:

  • Manufacturer authorization letter
  • Distributor agreement
  • Purchase invoice
  • Import documents
  • Customs documents
  • Authorized distributor documentation
  • Warranty documentation
  • Serial-number records
  • Brand licence
  • Other credible source evidence

The exact evidence required may depend on the Product and risk level.


8. Genuine Products and Counterfeits

Vendors must sell genuine Products.

The following are prohibited:

  • Counterfeit Products
  • Fake branded Products
  • Replica Products falsely presented as genuine
  • Products with forged serial numbers
  • Products with altered labels
  • Products with copied packaging intended to mislead Buyers
  • Products using unauthorized trademarks in a misleading manner
  • Products falsely claiming manufacturer authorization

Go Dokan may immediately suspend or remove a listing where there is a credible authenticity concern.


9. Genuine Products From Different Distribution Channels

A genuine Product is not automatically counterfeit merely because it was obtained through a distribution channel different from the manufacturer's preferred channel.

However, the Vendor remains responsible for complying with:

  • Applicable Nepal law
  • Import requirements
  • Trademark rules
  • Product safety requirements
  • Warranty commitments
  • Labelling requirements
  • Tax and customs requirements

Go Dokan may request documentation where the origin or authenticity of a Product is unclear.


10. Go Dokan Intellectual Property

Go Dokan and its licensors own or lawfully use intellectual property associated with the Platform, including:

  • Go Dokan name
  • Go Dokan logo
  • Go Dokan branding
  • Platform design
  • Website content
  • Original graphics
  • Software
  • User-interface elements
  • Documentation
  • Marketing materials
  • Original text
  • Other protected Platform materials

Except where expressly permitted, users must not copy, modify, reproduce, distribute, sell or exploit Go Dokan intellectual property.


11. Use of Go Dokan Branding

Vendors may not represent themselves as Go Dokan or as an official Go Dokan entity.

The following require prior approval where applicable:

  • Use of the Go Dokan logo
  • Official Go Dokan campaign artwork
  • Co-branded advertising
  • External advertisements claiming official Go Dokan endorsement
  • Marketing materials using Go Dokan trade dress
  • Statements claiming official Go Dokan partnership beyond the Vendor relationship

A Vendor may truthfully state that it sells through Go Dokan, provided the statement is accurate and does not create a misleading impression of endorsement or ownership.


12. Vendor Content Licence

By submitting lawful Product content to Go Dokan, the Vendor grants Go Dokan a non-exclusive, worldwide, royalty-free licence, for the duration reasonably necessary to operate the marketplace, to:

  • Host the content
  • Store the content
  • Display the content
  • Reproduce the content
  • Resize or format images
  • Adapt content for Platform presentation
  • Display Products in search results
  • Use Product content for fulfilment
  • Use content for customer support
  • Use content for compliance and investigation
  • Use content in relevant marketplace marketing where permitted

The licence does not transfer ownership of the Vendor's intellectual property to Go Dokan.

The Vendor remains responsible for ensuring that it has the rights necessary to grant this licence.


13. Removal of Vendor Content

Go Dokan may remove, restrict or disable Vendor content where:

  • A credible infringement complaint is received
  • The Vendor cannot provide reasonable authorization evidence
  • The content is counterfeit-related
  • The content violates applicable law
  • The content violates Platform rules
  • The content creates significant legal risk
  • A competent authority requires action
  • The Vendor repeatedly violates intellectual property requirements

Where practicable, Go Dokan may notify the Vendor and provide an opportunity to respond.

Urgent safety, counterfeit or legal matters may require immediate action.


14. Intellectual Property Complaints

A rights holder may submit an intellectual property complaint to Go Dokan.

The complaint should provide enough information to allow Go Dokan to identify the alleged infringement.

A complaint should normally include:

  1. Full name of the rights holder or authorized representative
  2. Contact email and telephone number
  3. Description of the intellectual property right
  4. Evidence of ownership or authorization
  5. Identification of the allegedly infringing Product or content
  6. URL or Product ID where available
  7. Explanation of why the content is allegedly infringing
  8. Supporting documents
  9. Statement that the information supplied is accurate
  10. Declaration of authority to submit the complaint

Incomplete complaints may require clarification before action can be taken.


15. Trademark Complaints

A trademark complaint should identify:

  • Trademark name
  • Registration details where applicable
  • Jurisdiction
  • Rights holder
  • Authorized representative
  • Relevant Product or listing
  • Explanation of alleged unauthorized use

Go Dokan may request additional evidence where necessary.


A copyright complaint should identify:

  • Original work
  • Copyright owner
  • Location of the original work where available
  • Allegedly copied material
  • Location of the material on Go Dokan
  • Explanation of the alleged infringement
  • Evidence of ownership or authorization

Go Dokan may request additional information before taking action.


17. Counterfeit Complaints

Counterfeit complaints should include evidence that helps distinguish genuine Products from suspected counterfeit Products.

Useful evidence may include:

  • Serial-number information
  • Product photographs
  • Packaging comparison
  • Manufacturer confirmation
  • Distributor confirmation
  • Purchase records
  • Authentication reports
  • Brand authorization information

Go Dokan may restrict the affected listing while investigating.


18. Investigation Process

After receiving a credible complaint, Go Dokan may:

  1. Register the complaint.
  2. Review the submitted evidence.
  3. Identify the relevant Vendor or content.
  4. Temporarily restrict the listing where appropriate.
  5. Contact the Vendor.
  6. Request authorization or source documents.
  7. Compare the evidence.
  8. Contact a rights holder or authorized representative where appropriate.
  9. Request additional information.
  10. Determine appropriate Platform action.

Investigation procedures may vary depending on urgency and legal requirements.


19. Vendor Response

Where practicable, the Vendor may be asked to provide:

  • Source invoices
  • Authorization letters
  • Distribution agreements
  • Import records
  • Manufacturer evidence
  • Product serial numbers
  • Copyright licences
  • Image licences
  • Trademark permissions
  • Other relevant documentation

The Vendor should respond within the deadline communicated by Go Dokan.

Failure to provide reasonable evidence may result in continued restriction or removal.


20. Counter-Claims and Disputes

If a Vendor believes that a complaint is incorrect, the Vendor may provide a response with supporting evidence.

The response may include:

  • Proof of ownership
  • Distribution authorization
  • Purchase invoices
  • Import documents
  • Licence agreements
  • Permission from the rights holder
  • Explanation of lawful trademark use
  • Evidence that the complaint identifies the wrong Product

Go Dokan may review the response before deciding whether to restore the content.


21. Repeat Infringement

Repeated intellectual property violations may result in stronger enforcement.

Possible actions include:

  • Listing removal
  • Content removal
  • Product delisting
  • Advertising suspension
  • Reduced Platform visibility
  • Settlement hold
  • Vendor account restriction
  • Suspension of Vendor privileges
  • Termination of Vendor participation
  • Reporting to competent authorities where required

Serious infringement may result in immediate action.


22. False Intellectual Property Complaints

Complaints must be made honestly and in good faith.

A person must not knowingly submit:

  • False ownership claims
  • Fabricated evidence
  • False authorization documents
  • Misleading trademark claims
  • Fraudulent copyright claims
  • Complaints intended to unfairly harm a competitor

Go Dokan may restrict complaint privileges or take other appropriate action against abusive complainants.


23. Advertisements and Promotional Content

Vendors must ensure that advertisements comply with this Policy.

Advertisements must not use another company's:

  • Logo
  • Trademark
  • Product image
  • Promotional artwork
  • Video
  • Music
  • Copyrighted text

without authorization or another lawful basis.

Advertising is also subject to the Go Dokan Advertisement Policy.


24. Reviews and User-Generated Content

Users must not post content that infringes intellectual property rights.

Examples include:

  • Uploading copyrighted images without permission
  • Posting copied promotional material
  • Uploading pirated software
  • Posting another person's protected content as one's own
  • Using protected logos in a misleading manner

Go Dokan may remove content that violates this Policy or applicable law.


25. Software and Digital Products

Vendors offering software, digital licences or downloadable Products must have the right to distribute them.

The Vendor must not sell:

  • Pirated software
  • Unauthorized activation keys
  • Stolen licence keys
  • Cracked software
  • Unauthorized digital copies
  • Malware disguised as software
  • Products that violate the applicable software licence

The Vendor may be required to provide evidence of legitimate distribution rights.


26. Music, Video and Audio

Music, video and audio used in:

  • Product videos
  • Advertisements
  • Promotional campaigns
  • Vendor storefronts

must be properly licensed or otherwise lawfully usable.

The fact that music or video is available on social media does not automatically grant commercial usage rights.


27. AI-Assisted and Generated Content

Vendors may use AI-assisted content where lawful.

However, AI-generated or AI-assisted content must not:

  • Infringe another person's intellectual property
  • Copy protected artwork without authorization
  • Impersonate a brand
  • Create misleading Product images
  • Falsely represent Product specifications
  • Create fake manufacturer endorsements
  • Misrepresent Product authenticity

The Vendor remains responsible for the final content.


28. Product Comparison and Competitor References

A Vendor may refer to another brand where reasonably necessary to identify compatibility or comparison, provided the reference is:

  • Accurate
  • Relevant
  • Non-misleading
  • Not presented as an endorsement
  • Not falsely suggesting affiliation

Comparative advertising must also comply with the Advertisement Policy.


Purchasing a physical Product does not automatically transfer copyright or trademark ownership associated with that Product.

For example, purchasing a branded device does not give the Buyer ownership of the brand's:

  • Logo
  • Trademark
  • Product photographs
  • Software
  • Marketing materials

The Buyer receives the rights associated with the lawful purchase, subject to the Product's applicable licence and law.


30. Record Keeping

Vendors should maintain evidence supporting their intellectual property rights and Product authenticity, including:

  • Purchase invoices
  • Supplier information
  • Distributor agreements
  • Manufacturer authorization
  • Import documents
  • Licences
  • Image permissions
  • Content licences
  • Trademark permissions
  • Product serial numbers
  • Warranty documents

Go Dokan may request relevant records during an investigation.


31. Privacy During IP Investigations

Information submitted during an intellectual property investigation may contain personal, commercial or confidential information.

Go Dokan will handle such information according to its Privacy Policy and applicable law.

Information may be shared where reasonably necessary for:

  • Investigation
  • Dispute resolution
  • Platform safety
  • Legal compliance
  • Protection of rights
  • Communication with the relevant Vendor or rights holder

32. Historical Transaction Records

Removing or deleting a Product listing does not necessarily erase historical records.

Product information may remain in:

  • Previous Orders
  • Invoices
  • Settlement records
  • Returns
  • Refunds
  • Warranty records
  • Complaints
  • Audit records
  • Legal records
  • Transaction history

This is necessary for lawful accounting, tax, compliance, dispute-resolution and record-retention purposes.


33. Enforcement

Depending on the circumstances, Go Dokan may take one or more of the following actions:

  • Remove content
  • Disable a listing
  • Restrict a Product
  • Suspend advertising
  • Request evidence
  • Notify affected Buyers
  • Freeze affected settlement amounts
  • Suspend a Vendor
  • Terminate Vendor participation
  • Preserve relevant evidence
  • Cooperate with rights holders
  • Cooperate with competent authorities

Go Dokan's response will depend on the seriousness, credibility and urgency of the matter.


34. Vendor Responsibility

The Vendor remains responsible for:

  • Product authenticity
  • Lawful sourcing
  • Intellectual property rights
  • Content authorization
  • Brand authorization
  • Product descriptions
  • Images
  • Videos
  • Marketing claims
  • Licences
  • Distribution rights

Go Dokan's publication or moderation of a listing does not transfer this responsibility to Go Dokan.


35. Go Dokan Review Does Not Equal Endorsement

A listing being published, verified or displayed on Go Dokan does not necessarily mean:

  • Go Dokan owns the Product
  • Go Dokan manufactures the Product
  • Go Dokan guarantees authenticity beyond the stated verification scope
  • Go Dokan endorses every Vendor claim
  • Go Dokan grants intellectual property permission

Vendors remain responsible for the legality and accuracy of their content.


36. Indemnity

To the extent permitted by applicable law, a Vendor may be responsible for claims, losses, penalties, costs and reasonable expenses arising from:

  • Unauthorized use of copyrighted material
  • Trademark infringement
  • Counterfeit Products
  • Unauthorized brand use
  • Infringing Product designs
  • Misleading intellectual property claims
  • Unauthorized advertising content
  • Vendor violation of applicable law

This is subject to the Vendor Marketplace Agreement.


37. Relationship With Other Go Dokan Policies

This Policy should be read together with:

Where a mandatory legal requirement conflicts with a Platform policy, the mandatory legal requirement prevails.


38. Governing Law

This Policy is governed by the laws of Nepal, including applicable:

  • Electronic commerce law
  • Consumer-protection law
  • Copyright law
  • Trademark law
  • Intellectual property law
  • Privacy law
  • Contract law
  • Electronic-transactions law

Nothing in this Policy removes a right or remedy that cannot lawfully be excluded.


39. Policy Changes

Go Dokan may update this Policy for:

  • Legal changes
  • Platform changes
  • Security requirements
  • Marketplace operational requirements
  • Intellectual property enforcement improvements

Material changes will be communicated where reasonably practicable.

The current version and effective date will be displayed on the Platform.

When submitting a complaint, include the Product URL or ID, description of the alleged infringement and supporting evidence whenever available.


Vendor Intellectual Property Checklist

Before publishing a Product, confirm:

  • I own or have permission to use the Product images.
  • I own or have permission to use the Product videos.
  • I own or have permission to use the Product description.
  • I am authorized to sell the branded Product where authorization is required.
  • The Product is genuine.
  • I can provide source or purchase documents if requested.
  • My trademark and brand claims are accurate.
  • My advertisements do not use unauthorized third-party content.
  • My promotional content does not falsely suggest manufacturer or Go Dokan endorsement.
  • My Product does not infringe another person's intellectual property.
  • I can provide licences or authorization evidence if requested.
  • I understand that Go Dokan may remove or suspend infringing content.
